1. Introduction
Welcome to SharedFoyerCommons ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our luxury yacht charter services and our website found at sharedfoyercommons.sbs (the "Service") provided by SharedFoyerCommons.
By securing a charter or utilizing our Service, you consent to be governed by these Terms. If you do not accept any part of the terms, you should not access the Service.
2. Service Overview
SharedFoyerCommons offers a range of high-end yacht charter services, which include, but are not limited to:
- Daily yacht charters
- Sunset voyages
- Business retreats
- Exclusive events
- Extended charters
Our services are provided based on availability and favorable weather conditions. We have the authority to amend or stop services without notice at any given time.
3. Booking and Reservations
3.1 Booking Process
For charter reservations, you must:
- Be at least 18 years old
- Submit accurate and comprehensive details
- Remit the necessary deposit as fixed in your booking acknowledgment
- Accept these Terms & Conditions
3.2 Confirmation
Reservations are deemed confirmed only after the reception of payment and our written acknowledgment. We hold the right to decline service at our discretion to anyone.
3.3 Availability
All charter services rely on the availability of the vessel and appropriate weather conditions. We strive to honor your requested dates and times to the best of our ability.
4. Payment Terms
4.1 Pricing
All fees are presented in € and incorporate all applicable taxes, unless noted otherwise. Costs are susceptible to modification with no prior notification.
4.2 Payment Schedule
- Initial Deposit: Half of the full charter fee payable upon booking
- Final Balance: Due two days ahead of the charter's start
- Incidental charges (if applicable): Payable at the conclusion of the charter
4.3 Payment Methods
We accept major credit cards, bank wire transactions, and official bank checks. Payment handling is performed using secure and encrypted methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours prior to departure: Full reimbursement minus transaction costs
- Between 24 to 72 hours before departure: 50% reimbursement
- Less than 24 hours before departure: No reimbursement provided
5.2 Weather Cancellations
Should our captain judge weather conditions to be unsafe, we propose to:
- Reschedule your charter free of charge to an upcoming available date
- Issue a full refund if rescheduling is not feasible
5.3 Vessel Malfunctions
Should there be mechanical malfunctions with the allocated vessel, efforts will be made to provide an adequate substitute. If such a substitute is not available, a full reimbursement will be issued.
6. Safety and Conduct
6.1 Safety Regulations
Every passenger must:
- Adhere to instructions from the crew
- Dress in the safety gear provided when necessary
- Disclose any medical issues that may affect their security
- Abide in specified sections of the vessel
6.2 Forbidden Items
The following are not allowed on board:
- Containers made of glass
- Unlawful items
- Firearms or other weapons
- Pets (except if granted permission beforehand)
6.3 Behavior
Travelers are required to act respectfully. We reserve the privilege to discontinue a charter prematurely with no refund if the conduct of any traveler poses a risk to safety or disturbs others.
7. Liability and Insurance
7.1 Our Responsibility
We are liable up to the payment made for your charter. We disclaim accountability for:
- Injuries incurred due to passenger rashness
- Theft or destruction of personal belongings
- Indirect losses, consequential damage, or punitive penalties
- Delays attributed to inclement weather or situations outside our control
7.2 Insurance Policies
We maintain thorough maritime insurance covering our fleet and operations. It is up to the passengers to secure their own travel and personal insurance.
7.3 Acceptance of Risk
By participating in our charter services, you recognize that activities at sea come with intrinsic dangers and you take on the liability for your safety and health.
8. Modifications and Itinerary Changes
Changes to the itinerary, routes, or schedules may be enacted based on meteorological conditions, safety requirements, or operational needs. We will endeavour to offer similar alternatives whenever possible.
9. Force Majeure
We shall not be accountable for postponements, cancellations, or alterations incurred by external forces outside our influence, this covers but is not restricted to:
- Extreme weather events
- Natural catastrophes
- Legal statutes
- Harbor shutdowns
- Vessel breakdowns
10. Privacy and Data Protection
Personal information is processed inline with our Privacy Policy. By employing our services, you allow for the amassing and usage of your details as outlined in our Privacy Policy.
11. Intellectual Property
Content on our web platform, such as text, visuals, branding, and images, are under the protection of copyright and trademarks. Unauthorized reproduction, dissemination, or creation of derived materials is prohibited without our explicit authorization.
12. Governing Law
The Terms are regulated by the laws existent in Germany. Any contention will be settled in courts situated in Hamburg, Germany.
13. Changes to Terms
We hold the right to adjust these Terms whenever necessary. Amendments will be published on our website with an updated date of revision. Continuing to use our services signifies agreement to the updated terms.
